DECLARATION OF ABSENCE OF THIRD-PARTY RIGHTS AND AUXILIARY TOOLS IN THE PROJECT

“NOAH’S ARK PLATFORM”

1. SUBJECT OF THE DECLARATION

This Declaration confirms that the exclusive rights to the “Noah’s Ark Platform” project, including but not limited to:

the concept, methodology, and business model of the Platform;
the 21-step process of real-estate collateral tokenization;
the name “Noah’s Ark” and related designations;
the original text of all supporting documentation (concept specification, explanatory notes, speech texts, presentations, one-pagers);
the financial models, legal mappings, roadmaps;
the logical schemes, diagrams, drawings, illustrations;
any derivative works and adaptations;

— belong exclusively to the author and rightsholder:

2. STATUS OF AUXILIARY SOFTWARE TOOLS

In preparing the project materials the rightsholder used various software tools of automation, including:

text processing and document layout systems;
automated information-retrieval systems over open sources;
automated proofreading and verification systems;
automated generation of technical artefacts;

All such tools were used solely as instruments in the rightsholder’s work — analogous to the use of word processors, spreadsheets, CAD/CAM systems, or search engines.

3. ABSENCE OF CLAIMS FROM TOOL VENDORS

In line with the established legal position:

U.S. Copyright Office Decision of 16.03.2023 “Works Containing Material Generated by Artificial Intelligence”;
Provisions on exclusive rights of the Civil Code of the Russian Federation (Art. 1228, 1257, 1259);
Civil Code of the Republic of Armenia (Art. 1100, 1101, 1106, 1108);
Berne Convention for the Protection of Literary and Artistic Works (Berne, 9 September 1886, as amended);
Universal Copyright Convention (Geneva, 6 September 1952) — establishing © as the universal copyright protection mark;

— works created using software tools as instruments are recognised as the works of the natural person who exercised the creative intent, selection, arrangement, and editing of the result.

Suppliers of the automation tools do not assert and have no right to assert claims to:

authorship;
exclusive property rights;
licence payments (royalties);
mention (attribution) among the authors;
any other form of participation in the legal regime of the work.

4. EXPRESS WAIVER OF RIGHTS

All organisations and services whose software tools were used in preparing the materials of the “Noah’s Ark Platform” project (hereinafter — the Tool Vendors), including the developers and operators of AI services of any generation, as well as their partners and affiliates:

Unconditionally and irrevocably waive any claims to intellectual rights in respect of the “Noah’s Ark Platform” project and any of its documentation, and confirm that the result of their use as instruments is the exclusive property of Kagirov Abdul-Khakim Akhmadovich.

5. UNDERTAKING OF NON-DISCLOSURE AND NON-USE

The Tool Vendors and any third parties through whom the rightsholder had indirect access to the software tools:

shall not use any project materials (in whole or in part) for their own commercial, research, training, or marketing purposes;
shall not include the project materials in model training sets, knowledge bases, or derivative products;
shall destroy any temporary copies of the project materials upon completion of the use of the relevant software tool.

6. APPLICABLE LAW AND JURISDICTION

This Declaration is governed by the law of the Republic of Armenia (as the jurisdiction of project implementation) and applicable international conventions in the area of intellectual property. Disputes shall be heard at the rightsholder’s choice.

7. CONFIRMATION BY THE RIGHTSHOLDER

By this signature I, Kagirov Abdul-Khakim Akhmadovich, confirm:

sole authorship and possession of the exclusive rights to the “Noah’s Ark Platform” project;
the use of software automation tools solely as instruments;
the absence of any obligations to Tool Vendors in connection with the project.
